Can I gain Unemployment and public protection Retirement?

Question: I am currently 65 years old. My request is, can I apply and get collective security benefits as well as Unemployment Compensation? Some population say you can't, but others say you can. What is the right answer? I live in Massachusetts.

Answer: I have received questions whether or not a man can secure collective security ("Ss") relinquishment benefits and unemployment benefits at the same time. Many population think you cannot do this.

The conception that you cannot secure both benefits at the same time comes from past history when indeed, you could not secure both. Ss is a federal agenda and unemployment payment is a state program. Years ago, a federal law required states to offset unemployment benefits by part or all of the collective security that a man was receiving. Fortunately, the federal law was changed to allow individual states to make the decision how this offset is handled.

Most states changed the state law to allow full relinquishment benefits with no offset due to Ss relinquishment benefits. At present, only Louisiana and Illinois offset unemployment benefits with collective security relinquishment benefits. South Dakota has changed its law, but the law has not yet been enacted so if you live in South Dakota, check with your state unemployment branch on when this will take affect.

The traditional federal law was enacted at a time when population retired at a much younger age and those who were still working and who could claim unemployment were a minority. As our population has aged and we are working well past the age for collecting Ss, this had to convert and thank goodness it has in most states.

So if you live in Louisiana, Illinois, and maybe South Dakota, your unemployment benefits will be reduced by fifty percent of your collective security benefits. However, whatever is great than nothing so go ahead and file for your unemployment. In all other states, you will get your full unemployment benefits.
